02 49 CFR § 397 Parking & Attendance Verdict
The 100-Foot Attendance Rule
Under 49 CFR § 397.5, a motor vehicle containing Division 1.1, 1.2, or 1.3 materials must be attended at all times. A qualified attendant must be awake, not in a sleeper berth, and within 100 feet of the vehicle with an unobstructed view.
What Qualifies as a Safe Haven?
A "safe haven" is strictly defined as an area approved in writing by local, State, or Federal governmental authorities for parking unattended vehicles carrying explosives. A commercial truck stop is legally NOT a safe haven under FMCSR.
Mandatory Written Route Plans
Prior to dispatch, carriers hauling 1.1, 1.2, or 1.3 explosives must provide drivers with a written route plan detailing exact origin, destination, approved safe havens, and emergency contacts. Any unauthorized detour creates severe DOT liability.
